Terms of Service

1. Acceptance of Terms
By accessing or using the WebconstructGlobal platform, website, APIs, or any associated services (collectively, the "Services"), you agree to be bound by these Terms of Service. If you are entering into this agreement on behalf of an organisation, you represent that you have authority to bind that organisation.
2. Service Description
WebconstructGlobal provides enterprise intelligence infrastructure including data integration, real-time analytics, operational dashboards, workflow automation, and predictive modelling capabilities. Service specifications, availability commitments, and support tiers are defined in the applicable Service Level Agreement ("SLA") executed between the parties.
3. Accounts & Access
You are responsible for maintaining the confidentiality of your credentials. Access is governed by role-based permissions configured by your organisation's administrator. Multi-factor authentication is required for all accounts. You must notify us immediately of any unauthorised access at security@webconstructglobal.com.
4. Acceptable Use
You agree not to: (a) attempt to gain unauthorised access to any part of the Services; (b) interfere with or disrupt the integrity or performance of the Services; (c) use the Services for any unlawful purpose or in violation of any applicable regulation; (d) reverse-engineer, decompile, or disassemble any aspect of the platform; (e) resell, sublicense, or redistribute access to the Services without prior written consent.
5. Intellectual Property
All platform software, documentation, interfaces, algorithms, and design elements are the exclusive property of WebconstructGlobal, Inc. and are protected by applicable intellectual property laws. Your data remains your property. We claim no ownership of data you ingest, process, or store through the platform.
6. Data Processing
Data handling is governed by our Privacy Policy and, where applicable, by a Data Processing Agreement ("DPA") executed between the parties. Enterprise clients may request GDPR-specific DPAs, Standard Contractual Clauses (SCCs), and data residency configurations.
7. Service Availability & SLA
WebconstructGlobal targets 99.97% platform availability. Scheduled maintenance windows are communicated at least 72 hours in advance. Service credits for downtime exceeding SLA thresholds are defined in the applicable SLA document.
8. Limitation of Liability
To the maximum extent permitted by applicable law, WebconstructGlobal's total cumulative liability for all claims arising under or relating to these Terms shall not exceed the fees paid by you in the twelve (12) months preceding the event giving rise to the claim. WebconstructGlobal shall not be liable for indirect, incidental, special, consequential, or punitive damages.
9. Termination
Either party may terminate the agreement with 30 days' written notice. Upon termination, we will provide a data export in a standard machine-readable format within 30 days of your request. After the export window, all client data is securely deleted in accordance with our data retention policies.
10. Governing Law
These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, without regard to conflict of law principles. Any disputes shall be resolved through binding arbitration in Johannesburg, Gauteng.
11. Changes to Terms
We may modify these Terms at any time. Material changes will be communicated via email to the account administrator at least 30 days before taking effect. Continued use of the Services after the effective date constitutes acceptance of the updated Terms.
